These Terms of Service (“Terms”) govern your access to and use of WPhead.cloud and all hosting, website, domain, email, storage, and related services provided by SEOtoolbox.io, Inc. (“WPhead.cloud”, “SEOtoolbox.io”, “we”, “us”, or “our”).

By creating an account, purchasing a service, or using WPhead.cloud, you agree to these Terms. If you do not agree with these Terms, you may not use our services.

1. Our Services

WPhead.cloud provides web hosting and related services, which may include:

  • WordPress hosting
  • Website hosting
  • Domain-related services
  • DNS services
  • Email hosting and mailboxes
  • Website storage
  • Databases
  • Backups
  • SSL certificates
  • Website management tools
  • Technical support
  • Other services made available through WPhead.cloud

Specific features, storage limits, bandwidth limits, mailbox limits, and other restrictions may vary depending on the service plan you purchase.

We may modify, improve, add, or discontinue features of our services from time to time.

2. Account Registration

You must provide accurate and complete information when creating an account.

You are responsible for:

  • Keeping your account information accurate and up to date
  • Maintaining the confidentiality of your passwords and login credentials
  • Securing access to your account
  • All activity performed through your account
  • Notifying us promptly if you believe your account has been compromised

You must not knowingly provide false, misleading, or fraudulent information when creating or maintaining an account.

You may not create accounts for the purpose of circumventing a suspension, termination, usage restriction, or other enforcement action.

3. Responsibility for Your Account

You are responsible for all activity associated with your account, including activity performed by employees, contractors, customers, website administrators, or other persons to whom you provide access.

If you allow another person to access your WPhead.cloud account or hosted website, you remain responsible for their activity.

You must take reasonable steps to prevent unauthorized access to your account, website, databases, FTP/SFTP accounts, control panels, email accounts, API credentials, and other services.

4. Acceptable Use

You may use WPhead.cloud only for lawful purposes and in accordance with these Terms.

You must not use our services to:

  • Violate applicable laws or regulations
  • Commit fraud or facilitate fraudulent activity
  • Infringe intellectual property rights
  • Distribute malware, viruses, ransomware, spyware, or other malicious software
  • Conduct phishing or credential theft
  • Attempt unauthorized access to computer systems or networks
  • Attack, disrupt, or interfere with our infrastructure or another party’s infrastructure
  • Operate open proxies or open mail relays
  • Conduct denial-of-service or distributed denial-of-service attacks
  • Distribute illegal content
  • Host content intended to facilitate criminal activity
  • Attempt to circumvent security controls
  • Interfere with the services or accounts of other customers
  • Use our infrastructure in a manner that creates an unreasonable risk to our network, reputation, systems, or other customers

We may take action against activity that we reasonably believe presents a security, abuse, legal, operational, or reputational risk to WPhead.cloud or others.

5. Email Services

5.1 General Email Use

WPhead.cloud email accounts are provided primarily for normal business, personal, transactional, and interpersonal communication.

You may use an email account associated with your domain to communicate with customers, employees, suppliers, business partners, and other legitimate recipients.

You are responsible for ensuring that your use of email complies with applicable laws and regulations.

5.2 Spam and Unsolicited Email

WPhead.cloud has a strict anti-spam policy.

You may not use WPhead.cloud email services to send, facilitate, relay, or distribute:

  • Spam
  • Unsolicited bulk email
  • Unsolicited commercial email
  • Mass marketing email
  • Email campaigns to recipients who have not requested or consented to receive such communications
  • Messages sent to purchased, rented, scraped, harvested, or otherwise acquired third-party email lists
  • Email generated from harvested email addresses
  • Chain letters
  • Pyramid or similar schemes
  • Deceptive promotional messages
  • Messages designed primarily to generate spam complaints or manipulate email reputation

This restriction applies regardless of whether the recipient is located in the same country as you.

You may not use WPhead.cloud’s standard mailbox service as a cold-email or bulk-email marketing platform.

If you need to send legitimate newsletters, marketing campaigns, promotional campaigns, or other large-volume commercial email, you should use a dedicated email marketing or transactional email provider designed for that purpose.

5.3 Purchased and Scraped Lists

You may not use WPhead.cloud email accounts to send messages to:

  • Purchased email lists
  • Rented email lists
  • Scraped email addresses
  • Automatically harvested addresses
  • Lists obtained from third parties where the recipients did not directly request communications from you
  • Lists obtained through questionable or unverifiable consent practices

The fact that an email address is publicly available does not, by itself, establish permission to send unsolicited commercial email to that address.

5.4 Consent and Mailing Lists

If you use WPhead.cloud services for mailing lists or recurring communications, you are responsible for obtaining any consent required by applicable law and maintaining appropriate records of that consent.

You must provide recipients with an appropriate mechanism to stop receiving marketing communications where required by law.

You must honor valid unsubscribe and opt-out requests.

For commercial email, applicable laws may impose requirements concerning sender identification, truthful headers and subject lines, physical address information, and opt-out mechanisms. For example, the U.S. CAN-SPAM Act applies to commercial email and requires, among other things, accurate sender information and a functioning opt-out mechanism.

5.5 Prohibited Email Practices

You may not use WPhead.cloud email services to:

  • Forge or falsify email headers
  • Spoof another person, organization, or domain
  • Impersonate another sender
  • Use deceptive sender information
  • Use misleading subject lines
  • Send phishing emails
  • Send malware or malicious attachments
  • Send fraudulent invoices or payment requests
  • Conduct business email compromise
  • Attempt to obtain passwords, credentials, financial information, or other sensitive information through deception
  • Operate an open SMTP relay
  • Circumvent our email sending restrictions
  • Use multiple accounts or domains to evade email limits
  • Intentionally generate excessive bounces
  • Send messages to invalid or systematically unresponsive addresses
  • Send email that results in excessive spam complaints
  • Send email to spam traps
  • Use our infrastructure to damage the reputation of another email provider or network

5.6 Email Sending Limits

WPhead.cloud may impose technical limits on the number, frequency, size, or destination of messages that may be sent through its email infrastructure.

These limits may vary by hosting plan and may be changed at any time where reasonably necessary to protect our infrastructure, deliverability, reputation, and other customers.

We may temporarily restrict outbound email from an account if we detect unusual activity, excessive volume, high bounce rates, spam complaints, compromised credentials, malware, or other behavior that presents a risk to our email infrastructure.

5.7 Protecting Email Accounts

You are responsible for protecting your email accounts against unauthorized access.

You should use strong, unique passwords and appropriate security measures.

You must not knowingly allow your mailbox, website, contact forms, scripts, or applications to be configured in a manner that permits unauthorized persons to send email through WPhead.cloud infrastructure.

If your account, website, or email credentials are compromised and used to send spam or malicious email, we may suspend outbound email, disable affected accounts, or take other action necessary to protect our systems and other customers.

5.8 Email Reputation and Blacklisting

Email infrastructure is shared or interconnected in ways that can cause abuse by one customer to affect other customers.

You must not use the services in a manner that causes or is reasonably likely to cause:

  • Our mail servers or IP addresses to be blacklisted
  • Significant damage to our domain or IP reputation
  • Excessive spam complaints
  • Significant delivery failures
  • Abuse reports
  • Complaints from other email providers
  • Suspension of our mail services by upstream providers

We may suspend or restrict email services immediately when necessary to protect our infrastructure or reputation.

5.9 Email Storage

Email storage is subject to the limits of your hosting plan.

You are responsible for managing your mailbox storage and maintaining copies of important messages.

We may restrict sending or receiving if a mailbox exceeds its applicable storage limit.

WPhead.cloud is not intended to be an unlimited archival or long-term email storage service unless expressly stated in your service plan.

6. Website Content

You are responsible for all content hosted through your WPhead.cloud account.

This includes websites, files, databases, images, videos, documents, applications, plugins, themes, scripts, and other materials.

You represent that you have the necessary rights, licenses, permissions, and legal authority to host and distribute your content.

We do not claim ownership of your website content.

You grant WPhead.cloud only the rights reasonably necessary to host, transmit, store, back up, and provide your content as part of the services.

7. WordPress and Third-Party Software

WPhead.cloud may provide WordPress, plugins, themes, scripts, and other third-party software.

Third-party software may be subject to its own licenses and terms.

You are responsible for:

  • Keeping software reasonably up to date
  • Maintaining secure passwords
  • Using reputable plugins and themes
  • Removing vulnerable or abandoned software
  • Maintaining appropriate security for your website
  • Ensuring that your use of third-party software complies with its applicable license

We are not responsible for vulnerabilities, security issues, incompatibilities, or defects originating in third-party software.

8. Resource Usage

WPhead.cloud services operate within defined resource limits.

You may not use shared hosting services in a way that:

  • Consumes excessive CPU or memory
  • Creates excessive disk or database activity
  • Interferes with other customers
  • Causes instability
  • Places an unreasonable load on our infrastructure
  • Attempts to circumvent resource restrictions

If your website or application substantially exceeds normal resource usage, we may contact you to discuss optimization, migration to a more appropriate plan, or another solution.

9. Backups

Where backups are included in your service, they are provided as a convenience and should not be considered a guaranteed replacement for your own backups.

You remain responsible for maintaining independent copies of important website files, databases, email, and other data.

Backup availability, frequency, retention, and restoration capabilities depend on the applicable service.

We do not guarantee that every file or database can always be restored.

10. Domains

Domain registrations and related services may be subject to the terms, policies, and requirements of the applicable domain registry and registrar.

You are responsible for providing accurate domain registration information and complying with applicable domain policies.

Domain registration fees may be non-refundable where permitted by the applicable registry or registrar rules.

11. Payments and Renewals

Services are provided according to the pricing and billing terms displayed when you purchase them.

Unless otherwise stated, paid services may automatically renew according to the selected billing period.

You authorize us or our payment provider to charge applicable fees when they become due.

You are responsible for keeping your payment information current.

If payment is unsuccessful or overdue, we may suspend or restrict the associated services.

12. Cancellation

You may cancel your services according to the cancellation process provided by WPhead.cloud.

Cancellation does not automatically eliminate amounts already owed.

Unless otherwise stated in a specific offer or service agreement, cancellation may result in the termination of access to the associated hosting, email, website, database, and other services at the end of the applicable billing period.

You are responsible for exporting any data you wish to retain before cancellation.

13. Suspension and Termination

We may suspend, restrict, or terminate services if:

  • You violate these Terms
  • You violate our Acceptable Use requirements
  • You engage in spam or email abuse
  • Your account is compromised
  • Your account presents a security risk
  • Your activity threatens our infrastructure or other customers
  • Your activity causes significant damage to our email or network reputation
  • You fail to pay applicable fees
  • We are required to do so by law
  • We reasonably believe suspension is necessary to prevent harm or abuse

For serious security, spam, fraud, phishing, or abuse incidents, suspension may occur immediately and without prior notice.

Where appropriate, we may provide an opportunity to resolve the issue before permanently terminating an account.

Termination or suspension does not eliminate your obligation to pay amounts already due.

14. Abuse Investigations

We may investigate suspected violations of these Terms.

You agree to reasonably cooperate with investigations relating to abuse, security incidents, spam, phishing, fraud, unauthorized access, or other violations.

We may request information reasonably necessary to determine whether your account or services are being used in violation of these Terms.

Failure to respond to a legitimate abuse or security inquiry may result in suspension or termination where reasonably necessary to protect our services or other customers.

15. Monitoring and Security

We may use automated systems and other technical measures to detect malware, spam, security threats, abnormal activity, and abuse.

We may inspect relevant technical information, metadata, logs, and other information reasonably necessary to investigate security and abuse incidents, subject to applicable law and our Privacy Policy.

We do not undertake to monitor all content or activity conducted through our services.

16. Intellectual Property

WPhead.cloud and its software, website, branding, documentation, interfaces, and related materials are owned by or licensed to SEOtoolbox.io, Inc.

You may not copy, reproduce, modify, distribute, reverse engineer, or exploit our proprietary systems except where expressly permitted by law or by us in writing.

Nothing in these Terms transfers ownership of our intellectual property to you.

17. Third-Party Services

WPhead.cloud may integrate with or provide access to third-party services.

Third-party services may have their own terms, privacy policies, licensing requirements, and fees.

We are not responsible for the availability, functionality, security, or policies of third-party services.

18. Service Availability

We aim to provide reliable hosting services but do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable due to:

  • Maintenance
  • Upgrades
  • Security incidents
  • Hardware or software failures
  • Network problems
  • Third-party infrastructure failures
  • Internet outages
  • Events outside our reasonable control

Where reasonably practical, we may provide advance notice of planned maintenance.

19. No Guarantee of Data Availability

Although we take reasonable measures to protect hosted data, you acknowledge that data stored on internet-connected systems can be lost, corrupted, damaged, deleted, or become inaccessible.

You are responsible for maintaining independent backups of important data.

20. Prohibited High-Risk Activities

Unless expressly authorized by us in writing, you may not use WPhead.cloud services for applications or activities where failure, interruption, or compromise could reasonably result in death, serious physical harm, or significant damage to property or critical infrastructure.

Examples may include certain life-support systems, critical infrastructure control systems, emergency systems, or other high-risk applications.

21. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SEOtoolbox.io, Inc., WPhead.cloud, and their officers, directors, employees, contractors, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from:

  • Your violation of these Terms
  • Your content
  • Your website
  • Your use of the services
  • Your violation of applicable laws
  • Your violation of another person’s rights
  • Your email activity
  • Spam, phishing, fraud, or abuse originating from your account

22. Limitation of Liability

To the maximum extent permitted by applicable law, SEOtoolbox.io, Inc. and WPhead.cloud will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings arising from your use of the services.

To the maximum extent permitted by applicable law, our total liability arising from the services will be limited to the amount you paid to WPhead.cloud for the affected service during the period specified by applicable law or, where no period is specified, the preceding twelve months.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the services are provided on an “as available” and “as is” basis.

We do not guarantee that:

  • The services will always be available
  • The services will be uninterrupted
  • The services will be completely secure
  • The services will be error-free
  • Websites hosted through our services will always be accessible
  • Email will always be delivered
  • Email will never be classified as spam
  • Backups will always be available or complete
  • Third-party services will remain available or compatible

24. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the beginning of this document.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of WPhead.cloud after updated Terms become effective constitutes acceptance of the revised Terms.

25. Governing Law

These Terms shall be governed by the laws applicable to SEOtoolbox.io, Inc., without regard to conflict-of-law principles, except where applicable consumer or mandatory data protection laws require otherwise.

Nothing in this section is intended to remove rights or protections that cannot legally be waived.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

27. Entire Agreement

These Terms, together with any applicable service-specific terms, Privacy Policy, Acceptable Use Policy, Data Processing Agreement, and other policies expressly incorporated into these Terms, constitute the agreement between you and SEOtoolbox.io, Inc. regarding your use of WPhead.cloud.

Customers who need to conduct legitimate bulk or marketing email campaigns should use a dedicated email delivery or marketing platform designed for that purpose.

WPhead.cloud may immediately restrict or suspend email services where activity threatens the security, deliverability, reputation, or operation of WPhead.cloud’s email infrastructure or other customers’ services.
